General Terms and Conditions of Dentist Himmi, trading under the name Dentist F. Himmi, Bagijnenstraat 6, 1811 KA in Alkmaar (Chamber of Commerce 53961161) www.tandartsalkmaar.nl, hereinafter referred to as: “Dentist Himmi”.

1. The Agreement
1.1 These general terms and conditions form an integral part of the treatment agreement pursuant to Article 7:446 paragraph 1 of the Dutch Civil Code between Dentist Himmi and the client, hereinafter referred to as the Agreement.

2. Execution of the Agreement
2.1. Dentist Himmi guarantees that the work she performs under this Agreement meets the standards that a good healthcare provider must observe and is in accordance with the statutory provisions (including the WGBO) as well as the generally applicable guidelines.
2.2. Dental treatments fall under medical/health treatments. The (dentist) has an obligation of effort and not an obligation of result.
2.3. Dentist Himmi is entitled to engage third parties in the performance of the Agreement. Dentist Himmi is not liable for the actions of these third parties.
2.4. The Client must at all times inform Dentist Himmi fully and truthfully about the general health of the Client and about circumstances that may affect the treatment.

3. Costs
3.1. The costs of dental treatment are declared in accordance with the applicable UTP rates as established by the NZa and laid down in the dental care tariff decision (www.NZa.nl).
3.2. The dental care rate list can be consulted on the website of Dentist Himmi mentioned in the introduction. The rates may be adjusted from time to time.
3.3. For all treatments that amount to a total of EUR 250 or more, Dentist Himmi will provide an estimate prior to the treatment.
3.4. In the event of a necessary change in the treatment as a result of unforeseen complications during the treatment, which result in an excess of the budget, the additional costs to be incurred will be charged to the client after consultation with the client.
3.5. Technical costs are charged separately. At the request of the client or his insurer, Dentist Himmi will provide the specification.

4. Cancellation of appointments
4.1. Scheduled appointments can be rescheduled or cancelled by the client free of charge up to 48 hours before the scheduled time. If the appointment is not rescheduled or cancelled in time, Dentist Himmi will charge the reserved time and/or agreed treatment with code C90, taking into account the duration of the planned treatment, for which reference is made to the price list which can be found on the websites mentioned in the introduction.
4.2. Dentist Himmi is at all times authorized to reschedule or cancel scheduled appointments with the client.

5. Cancellation of treatment
5.1. If the client cancels the treatment in whole or in part after a treatment agreement has been concluded, Dentist Himmi is entitled to charge the client in full for all costs incurred by her and third parties in connection with that treatment.

6. Declaration
6.1. The payment terms for dental care apply to the treatment agreement and these general terms and conditions. These can be found at https://knmt.nl/sites/default/files/knmt-betalingsvoorwaarden-editie-2021.pdf and were filed on 19 December 2012 by the Royal Dutch Society for the Promotion of Dentistry (KNMT) (at the time under the name of the Dutch Society for the Promotion of Dentistry (NMT)) with the registry of the court in Utrecht under number 12/2013.

7. Advertising
7.1. Complaints about the work performed or the invoice must be reported in writing to Dentist Himmi by the client within 30 days of discovery, but no later than three months after completion of the work in question.
7.2. A complaint as referred to in the first paragraph does not suspend the client's payment obligation.
7.3. The complaint will be handled by Dentist Himmi in accordance with the Complaints Procedure of the Royal Dutch Society for the Advancement of Dentistry.
7.4. If a complaint is justified and recovery is possible, Dentist Himmi will still carry out the work as agreed.

8. Liability
8.1. Rights to compensation for liability expire after 1 year after the event causing the damage occurred.
8.2. The Client cannot derive any rights from the calculation made by Zorgsom.

9. Applicable law
9.1. Dutch law applies to all agreements between the client and Dentist Himmi.
9.2. All disputes relating to the Agreement between the client and Dentist Himmi, to which these general terms and conditions apply, will be settled by the Court of North Holland.

10. Other provisions
10.1. If any provision of these general terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions.
